These terms apply to use of the InTheCold website and, unless a separate written contract says otherwise, to the InTheCold monitoring and support services.

Relationship with customer contracts

If you have an agreed order form, quotation, service agreement or other written customer contract with us, that document prevails if it conflicts with these website terms.

Website use

You may use the website for lawful business enquiries, reviewing InTheCold information and contacting us about services. You must not misuse the website, interfere with its operation, attempt unauthorised access or submit unlawful, abusive, malicious or rights-infringing content.

Service overview

InTheCold provides wireless temperature monitoring, alerts, records, reporting and support for UK businesses, including food, hospitality, healthcare, agriculture, storage and transport operations.

Customer responsibilities

Operational compliance

Monitoring assists operational oversight and record keeping. It does not replace food-safety procedures, calibration obligations, inspections, human checks, professional judgement or legal and regulatory duties. The service is not a medical device and should not be treated as one.

Accounts and credentials

You are responsible for keeping account credentials secure, using appropriate access controls and telling us promptly if you suspect unauthorised access. We may suspend access where reasonably necessary to protect the service or other customers.

Acceptable use and WhatsApp

You must not use the website, dashboard, email, telephone or WhatsApp channel to send unlawful, abusive, malicious, confidential third-party, infringing or unnecessary sensitive content. WhatsApp delivery may be affected by Meta, telecoms networks, internet connections, handset availability and other third-party systems.

Intellectual property and submitted content

Website content, branding, software, dashboards and documentation belong to us or our licensors. You may not copy or reuse them except as allowed by law or a written agreement. You give us permission to use information, screenshots, files and messages you submit only as needed to respond to enquiries, provide support, operate services and meet legal obligations.

Availability, maintenance and events outside control

We aim to provide a reliable service, but we do not promise uninterrupted alert delivery or continuous availability. Maintenance, faults, connectivity issues, third-party services, power failures, extreme events, legal restrictions or other circumstances outside reasonable control may affect availability.

Charges and taxes

Charges, taxes, payment terms and subscription details are as set out in the applicable quotation, order form, invoice or customer contract. These terms do not introduce any standalone price list.

Suspension and termination

We may suspend or terminate access at a high level where payment is overdue, the service is misused, security is at risk, continuing service would be unlawful, or a customer contract allows it. Any customer contract remains the primary source for detailed suspension and termination rights.

Warranties and liability

We provide the website and services with reasonable skill and care in a B2B context. We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, liability is governed by the applicable customer contract and by law.

Third-party links and services

The website and communications may link to third-party websites or depend on third-party networks and platforms. We are not responsible for third-party content, availability or policies.

Changes to these terms

We may update these terms from time to time. The updated version will be published on this page with a new last-updated date. Material service-contract changes will be handled according to the relevant customer contract.

Governing law

These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, while preserving any mandatory rights that legally apply.
